Terms and conditions

Settle Fitness Pty Ltd (we, us, our) operates settlefitness.com (the Website) and sells home fitness equipment. These Terms and Conditions govern all purchases, use of the Website, and our services. By placing an order, you (customer, you) agree to these Terms, which incorporate our Privacy Policy, Shipping Policy, and Warranty Terms. These Terms comply with the Australian Consumer Law (ACL) and do not limit your statutory consumer guarantees for acceptable quality, fitness for purpose, matching description, or repair/replacement rights for failures.

Orders and Pricing

Orders are offers to purchase; we may accept, reject, or cancel them at our discretion (e.g., stock unavailability, pricing errors). Prices are in AUD, include GST, and exclude shipping unless stated. We reserve the right to correct errors; you agree to pay the corrected price or cancel for refund. No orders from minors or restricted regions. Payment via accepted methods (credit card, PayPal, bank transfer) is due at checkout; title passes on full payment and delivery.

Shipping and Delivery

Shipping times are estimates (typically 5-14 days from Sydney warehouse for Australian metro areas); delays due to carriers, customs (for imports), or force majeure (e.g., strikes, weather) are not our liability. Risk transfers to you on delivery handover. Inspect goods on arrival; report damage within 48 hours via settlefitnessau@gmail.com for claims. 

 

Limitation of Liability

To the maximum extent permitted by law, our liability is limited to product refund/replacement/repair under ACL. We exclude indirect/consequential damages (e.g., injury from misuse, lost profits). Products suit normal home fitness use; assess suitability yourself. Indemnify us against claims from your misuse or third-party actions. Governing law: NSW, Australia; disputes via negotiation, then NSW courts.

Website Use

You use the Website at your risk; we provide it “as is” without warranties. Prohibited: hacking, scraping, unauthorized copying. We own all intellectual property (images, descriptions); limited license for personal use. Links to third-party sites are not endorsements.

Changes and Governing Law

We may update Terms (notified on Website); continued use implies acceptance. These Terms are the entire agreement. Severability: invalid clauses do not affect others. Force majeure excuses delays.
